Currently, the revision is on its final phase.</em></p><p style="line-height: 1.5;"><strong>Book II: Administrative Affairs</strong><br /><strong>Chapter II: Leave Privileges</strong><br /><strong>Article 148. Definition of Terms</strong></p><p><span style="text-decoration: underline;">f. Paternity Leave</span> refers to the privilege granted to a married male employee allowing him not to report for work for seven (7) days while continuing to earn the compensation therefor, on condition that his legitimate spouse has delivered a child or suffered a miscarriage, for purpose of enabling him to effectively lend care and support to his wife before, during and after childbirth as the case maybe and assist in caring for his new born child.</p><p><strong>Article 152. Paternity Leave</strong></p><p style="padding-left: 40px;"><strong>a.</strong> Every married male employee is entitled to paternity leave of seven (7) working days for the first four (4) deliveries of his legitimate spouse with whom he is cohabiting.</p><p style="padding-left: 40px;"><strong>b.</strong> The first of the 4 deliveries shall be reckoned from the date of effectivity of the paternity Leave Law on July 15, 1996.</p><p style="padding-left: 40px;"><strong>c.</strong> Married male employee with more than one (1) legal spouse shall be entitled to avail of paternity leave for an absolutely maximum of four deliveries regardless of whichever spouse gives birth.</p><p style="padding-left: 40px;"><strong>d.</strong> Paternity Leave shall be non-cumulative and non-commutative. 74</p><p style="padding-left: 40px;"><strong>e.</strong> Paternity leave may be enjoyed continuously for seven (7) working days or intermittently by the employee on the days immediately before, during and after childbirth or miscarriage of his legitimate spouse.</p><p style="padding-left: 40px;"><strong>f.</strong> Paternity leave for adoptive father. Pursuant to Section 34 of the Implementing Rules and Regulations of RA 8552, otherwise known as the Domestic Adoption Act of 1998, paternity benefit shall be given to the adoptive father, with respect to the adopted child, if the adoptee is below seven (7) years of age as of the date the child is placed with the adoptive parents through the Pre-adoptive Placement Authority issued by the Department of Social Welfare and Development.</p>						</div>
