Chapter 36: Complaints and Grievance Machinery
Article 364. Definition of Terms

a. Complaint means a faculty’s expressed (written or spoken) feelings dissatisfaction with some aspects of his/her working conditions, relationships, or status which are outside his/her control. This does not include those including disciplinary actions which are governed by separate rules.

b. Grievance refers to a work-related issue giving rise to faculty dissatisfaction. The following cases shall be acted upon through the grievance machinery:

i. Non-implementation of policies, practices, and procedures on economic and financial issues and other terms and conditions of employment fixed by law including salaries, incentives, working hours, leave benefits, and other related terms and conditions.

ii. Non-implementation of policies and procedures which affect the faculty from recruitment to promotion, detail transfer, retirement, termination, lay-offs, and other related issues that affect them.

iii. Physical working conditions.

iv. Interpersonal relationships and linkages.

v. Protest on appointments.

vi. All other matters giving rise to faculty dissatisfaction and discontentment outside of those cases enumerated herein.

c. Grievance Procedure. This refers to the method of determining and finding the best way to remedy the specific cause or causes of the complaint or grievance.

Article 365. Parties in Complaint.
Complaints and grievances may exist between and among individual faculty members and Supervisor/Management and between the Management and Recognized Negotiating Bargaining Unit on any and all matters which give rise to faculty dissatisfaction.

Article 366. Members of faculty shall have the right to present their complaints and/or grievances to the management and have them settled as expeditiously as possible in the best interest of the faculty concerned, union/association, agency/organization, and the government as a whole.
